In conciliation hearing held in Florianópolis on Friday, 24, the councilor of the Capital and candidate for re-election Dalmo Deusdedit Meneses (PP) and the required Facebook Online Services of Brazil, Alexandre Coutinho Carolo, Guilherme Ribeiro de Toledo Barros and Gayan Klippel accepted the conciliation proposal made by the judge of the 13th Electoral Zone, Luiz Felipe Siegert Schuch, to close the process that was opened by parliamentary action due to anonymous comments posted against him on the page “Reage Praia Mole”.
The penalties applied in the case against Facebook, which consisted of the removal of the website from the air in the country for 24 hours and a daily fine of R $ 50 thousand for non-compliance with the injunction, were revoked because the company identified the two pages initially involved in the disrespect of electoral legislation.
Change to the homepage
At the meeting, the parties to the proceedings agreed on eight points. In both points, the site committed to maintaining and equipping a central office to receive the determinations of the Electoral Justice and to place on its Brazilian homepage, with emphasis and easy access, warning users about the rules of use of the social network.
This statement should inform the responsibility of users regarding offensive, anonymous and false-profile posts, and warn that, in case of judicial determination, Facebook will identify the responsible in their registrations and exclude the messages and even the page in which it is found to be a violation of Brazilian legislation.
In the latter case, the interested party should clearly and accurately specify the “URL” address of the illegal page or content to be excluded.
Other parts
Klippel, creator and administrator of the page “Reage Praia Mole”, committed to daily excluding illegal and offensive messages until the end of the first round and posting retraction in the community, or in any other created for the same purpose, regarding the content of claims of this type, in this considered anonymous ones, launched against the Councilman Meneses.
In the retraction presented and joined to the process, Klippel recognizes the “radical position” of the Reage Praia Mole Movement and states that the candidate for re-election is not contrary to the environmental preservation of Florianópolis and neither to the project of expansion of the Municipal Park of Galheta.
Carolo, owner of the lan house in which the page was created, has committed to keeping up-to-date the registration of users of the computers on his property.
